These Terms of Service ("Terms") govern your access to and use of the website, platform, and services provided by NextBigNames ("we," "our," "us"). By accessing or using our platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our website or services.
NextBigNames provides Creator Contests, Battles, creator profiles, voting, prize promotions where offered, and related services.
In these Terms:
You must be at least 13 years old to use the NextBigNames platform. If you are located in a region where a higher minimum age applies to online services or digital consent, you must meet the age requirements of your region.
By using the platform, you represent and warrant that you meet the applicable age requirement and have the legal capacity to enter into these Terms.
If you use the platform on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
The following follower-range and grouping rules apply to Creator Contests and to creators participating in those contests. They do not apply to ordinary Battle Options, which are subjects presented for community voting and are not required to be registered users or contest participants.
Follower ranges are approximate. Participants may be grouped into Creator Contests based on their publicly available follower counts or ranges determined by the platform. The platform may apply tolerance margins or rounding thresholds to determine contest placement to maintain fairness and avoid strict numeric cutoffs.
Creator Contest group assignments are made at the platform's discretion and may not be appealed.
We may verify follower counts through automated means, manual checks, third-party services, or public profile inspection. We may reassign a participant to a different Creator Contest group if the follower count appears inaccurate, misleading, artificially inflated, or inconsistent with publicly available information.
An account is not necessarily required merely to cast a vote. An account may be required for certain features (such as participating in Creator Contests as a creator, managing a profile, viewing vote history, saving favourites, or prize eligibility where a Promotion requires an account).
When you sign up, log in, or request a password reset, you do so through forms on the NextBigNames website. Behind the scenes, account authentication (including email verification, secure credential storage, and password reset emails) is provided by our authentication provider, Supabase, acting on our behalf.

You are responsible for all activity that occurs under your account.
NextBigNames hosts Creator Contests in which users can vote for influencers, creators, or participants, and Battles in which users choose among two or more Battle Options. Some Creator Contests may be grouped by follower ranges or other criteria defined by us. Certain Creator Contests may be free to enter, while others may require a participation fee, as described in the applicable contest or campaign details. Battles are a separate voting experience and are not a replacement for Creator Contests.
Voting limits may apply (for example, one vote per Battle, or other limits described for a particular Creator Contest). Email or account verification may be required before a vote is accepted. We use technical measures, such as secure cookies, email verification, and, for logged-in users, internal user identifiers, to help prevent duplicate voting and maintain fairness. However, you acknowledge and agree that:
NextBigNames may suspend, modify, close, extend, or cancel a Battle or Creator Contest when reasonably necessary because of fraud, abuse, technical issues, errors, or other operational reasons. We may also change Creator Contest rules, eligibility criteria, fees, or rewards where necessary or appropriate, including for legal or technical reasons.
We reserve the right, in our sole discretion, to remove, disqualify, suspend, or deny participation to any applicant or participant at any time. This includes situations involving suspected fraud, manipulation, vote abuse, inappropriate content, violation of these Terms, or behavior we determine harmful to fairness, safety, or contest integrity. Such decisions are final and may not be appealed.
Battles may reference people, artists, creators, brands, products, games, films, organizations, or other subjects for community voting and entertainment. Unless expressly stated otherwise, inclusion in a Battle does not mean that the subject created, authorized, sponsored, endorsed, or is affiliated with NextBigNames or the Battle. Battle Options are not, by themselves, registered user accounts, Creator Contest participants, partners, or User Content.
Creators may maintain profiles and submit content such as images, descriptions, links to social media profiles, and other materials ("User Content").
By submitting User Content, you represent and warrant that:
You grant NextBigNames a non-exclusive, worldwide, royalty-free license to host, display, and use your User Content in connection with the platform, including in Creator Contests and promotional materials for NextBigNames itself.
We reserve the right, but are not obligated, to review, remove, or restrict access to User Content that we believe violates these Terms or applicable law.
Vote manipulation of any kind is strictly prohibited. This includes automated voting, creating fake or duplicate accounts, purchasing votes, incentivizing fraudulent activity, or attempting to bypass voting controls or limits. We may review, audit, or invalidate votes that appear automated, suspicious, or inconsistent with fair use.
You agree not to use the platform to:
We may suspend or terminate your access if we reasonably believe you have violated these Terms or engaged in conduct that may harm NextBigNames, other users, or third parties.
We may provide creators with analytics such as counts of profile link clicks (for example, "View Instagram" clicks) and other engagement metrics.
These metrics are generated using internal event tracking and/or third-party analytics tools and are provided for informational purposes only. While we aim for accuracy, we do not warrant that any metrics or analytics are completely error-free, real-time, or complete.
You agree that NextBigNames will not be liable for any decisions you make based on these metrics or for any discrepancies or omissions in such analytics.
From time to time, NextBigNames may run random prize draws, giveaways, or other promotions (collectively, "Promotions") associated with a Battle, a Creator Contest, or the platform generally, for eligible users, such as registered users on the platform. Not every Battle or Creator Contest includes a prize. These Promotions are separate from any paid Creator Contest entry fees and are not conditioned on payment.
Unless stated otherwise in specific Promotion rules, you acknowledge and agree that:
Additional rules or terms may apply to specific Promotions; in case of any conflict between those rules and these Terms, the specific Promotion rules will generally govern for that Promotion.
Some features of the platform, such as participation in certain contests as a creator, may require payment of fees. Any applicable fees, pricing, and payment terms will be described at the point of purchase or in the specific contest or campaign details.
Contest participation fees may be communicated to approved creators directly (for example, by email or via the social media contact details you provide) after we match you with a contest. Fees may vary depending on the contest, category, and/or follower-range grouping (for example, contests for creators with 5k–10k followers may have different fees than contests for creators with 200k–250k followers).
Any fee quote or invitation is not binding until confirmed by NextBigNames and accepted by you, and (where applicable) the payment is successfully completed.
By submitting a payment, you agree to pay the fees described, including any applicable taxes or charges, using a valid payment method. Payments are processed by third-party payment processors, and you may also be subject to their terms and conditions.
Unless expressly stated otherwise, fees for contest participation or other paid services are non-refundable, even if you do not win a contest, your ranking changes, or you choose to stop using the platform. Paying a fee does not guarantee any specific outcome, ranking, exposure, or prize.
We reserve the right to change our fees and pricing at any time, but changes will generally not apply retroactively to fees you have already paid.
The NextBigNames platform may integrate or interact with third-party services, such as authentication providers (including Supabase), analytics services (such as Google Analytics), payment processors, advertising partners (such as Google AdSense), and external social media platforms (for example, Instagram or TikTok).
These third parties operate under their own terms and privacy policies. We do not control and are not responsible for the content, policies, or practices of third-party services. Your use of third-party services is solely between you and the applicable third party.
All rights, title, and interest in and to the NextBigNames platform, including its design, features, branding, and underlying technology, are owned by NextBigNames or its licensors and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our platform, nor may you reverse engineer or attempt to extract the source code, unless laws prohibit those restrictions or you have our written permission.
Names, logos, trademarks, and other rights belonging to third parties — including artists, brands, games, films, products, or organizations that appear as Battle Options — remain the property of their respective owners. NextBigNames does not claim ownership of those third-party rights merely because they appear in a Battle or elsewhere on the platform.
Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.
By using NextBigNames, you acknowledge that you have read and understood our Privacy Policy.
The NextBigNames platform is not intended for children under the age of 13, or under the minimum digital consent age in your region if it is higher than 13. We do not knowingly allow children under this age to create accounts or participate as creators.
If we become aware that a child under the applicable minimum age has created an account, we may take steps to delete the account and associated data, as described in our Privacy Policy.

To the fullest extent permitted by law, the NextBigNames platform and all content, Battles, Creator Contests, analytics, metrics, Promotions, and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
Without limiting the foregoing, we do not guarantee that:
To the maximum extent permitted by law, NextBigNames and its affiliates, directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to these Terms or your use of the platform will be limited to the amount (if any) you have paid to us for use of the platform during the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless NextBigNames, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:
We may suspend or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if necessary for security, legal, or operational reasons.
You may stop using the platform at any time. Certain provisions of these Terms, including those relating to intellectual property, disclaimers, limitations of liability, and indemnification, will survive termination.
Due to the nature of voting systems and automated safeguards, Battle and Creator Contest results and vote counts may not always be perfect. You agree that results and vote totals are final and binding except where we determine a verifiable technical or fraudulent issue occurred.
If permitted in a specific Battle or Creator Contest, any dispute or review request must be submitted within 48 hours after results are posted. We are not obligated to re-evaluate votes or rankings and may deny review requests in our discretion.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the platform after changes have been posted constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada, unless applicable law requires otherwise.
